Selling a home in Mexico as a foreigner involves some basic steps and considerations. We can easily guide you through it!


Here's a general outline of the process we will work with you through:


  • Engage a Real Estate Agent: It's advisable to work with a reputable real estate agent who specializes in international transactions and has experience dealing with us foreigners. We can guide you through the process and ensure compliance with local regulations.


  • Gather Documentation: Prepare all necessary documentation related to your property, including the property deed (Escritura), property tax receipts, utility bills, and any other relevant paperwork.


  • Appraisal and Pricing: Get a professional appraisal to determine the market value of your property.


  • Marketing and Promotion: We will advertise and promote your property through various channels.


  • Negotiation and Offer Acceptance: Potential buyers will submit offers through their realtor. You have the right to accept, reject, or counter any offer. Negotiate the terms and conditions of the sale until an agreement is reached.


  • Sales Agreement: Once both parties agree on the terms, a sales agreement or purchase offer (Contrato de Compra-Venta) is drawn up. This document outlines the terms, conditions, and payment schedule for the sale.


  • Trust (Fideicomiso) or Direct Deed: As a foreigner, you may own property in Mexico through a bank trust called a Fideicomiso (for properties located within the restricted zone, typically within 50 km of the coast or 100 km of the border). If your property is outside the restricted zone, you can hold the title directly. The necessary steps for transferring the title depend on the ownership structure.


  • Closing Costs: Prepare for closing costs, which typically include notary fees, capital gains taxes, real estate agent commissions, and any outstanding property taxes or liens. These costs are usually shared between the buyer and seller, as negotiated.


  • Notarization and Escrow: The sales agreement is typically notarized, and the transaction is processed through an escrow account. The notary will verify the legal status of the property, ensure all fees and taxes are paid, and facilitate the transfer of funds.


  • Capital Gains Taxes: As a foreigner, you may be subject to capital gains taxes in Mexico. We will help you understand your tax obligations and determine if any exemptions or deductions apply.


  • Closing and Title Transfer: Once all conditions of the sales agreement are met, and the funds are in escrow, the final closing takes place. The notary public will oversee the signing of the deed and transfer the title to the buyer upon receipt of the full payment.
